Full text
33. The sale of any species of live fish is prohibited except for fish of a saltwater species.
Despite the foregoing, the sale of live fish is authorized where the fish are sold by a holder of an aquaculture licence issued under the Act respecting commercial aquaculture (chapter A-20.2), a holder of a commercial fishing licence, except as regards Atlantic salmon, or a holder of a fishing pond licence to a holder of a fishing pond licence or a holder of an aquaculture licence issued under the Act respecting commercial aquaculture.
This section does not apply to the sale of Atlantic salmon caught in the territory governed by the Act respecting hunting and fishing rights in the James Bay and New Québec territories (chapter D-13.1) by a Native person defined in section 1 of that Act, under a commercial fishing licence issued under the Quebec Fishery Regulations, 1990 (SOR/90-214), or caught under a communal fishing licence issued under the Aboriginal Communal Fishing Licences Regulations (SOR/93-332) to the extent that the latter licence authorizes the sale of Atlantic salmon and the holder complies with the other conditions set out therein.
